Family Law
Separating or getting a divorce can be one of life’s most stressful experiences. Individuals often face emotional turmoil as they navigate the complexities of ending a relationship. Both married and common-law couples can separate when one or both partners decide the relationship is over, which may involve physical separation or living together but no longer acting as a couple. The mandatory one-year separation period for divorce starts when one partner believes the relationship is irreparably broken.
Divorce has significant implications, including spousal support, property division, and health benefits. If children are involved, custody arrangements, child support, and parenting plans must also be addressed. Understanding your rights during this process is crucial, making experienced legal counsel essential.
At MTC Law, we offer tailored legal representation for separation and divorce. Our dedicated lawyers prioritize a customer-centered approach, ensuring your rights are protected while exploring reconciliation options when feasible. We are passionate, understanding, and tough when necessary; committed to your wellbeing through this difficult time.
Divorce
Divorce is the beginning of a new life, and with it, comes proper planning and setting yourself up for life after divorce. For this reason, approaching separation and all issues relating to it, including financial, support and parenting time can be overwhelming. Even small mistakes can cost fortunes and children’s lives may be harmed. We can help.
Spousal Support & Maintenance
Separation can be financially challenging. When separating from your spouse, you may be eligible to receive financial benefits them, called spousal support or spousal maintenance. Spousal support is different from child support, as it is not a right of a spouse. You may be eligible for spousal support if you were married, if you lived in a common law relationship for at least two years, or if you lived in a common law relationship for less than two years and have a child with your ex-spouse.
Child Support
Children are a priority, and legislation reinforces this by establishing child support as a fundamental right. This support extends not only to biological children but also to stepchildren, provided that the spouse has treated the child as their own.
In situations where finances are constrained, child support obligations take precedence over spousal support. It’s crucial to understand these priorities to ensure that children’s needs are adequately met during family separations. By recognizing the importance of child support, we can better navigate the complexities of financial obligations and ensure that children’s well-being remains at the forefront during such transitions.
Child Custody & Parenting Arrangements
How each separated parent will be involved in their child’s life is a very important decision. The responsibility for children (guardianship) and the responsibilities the guardians have (parental responsibilities and parenting time) are decided upon for the best interest of the child, not the parents’ “rights”.
The determination of custody for the best interest of the child is to protect your child’s physical, psychological, and emotional safety, security and well-being.
Property Division
For many people going through a separation or divorce, the division of property can be a very daunting and complicated situation.
Family property must be divided between spouses when their marital or common law relationship ends. Parties are in a common-law relationship after living together in a “marriage-like” relationship for two years. While your situation is unique to your current relationship, we have experience to help smooth out the task of dividing your property.
Adoption
Deciding to adopt is a major milestone for any parent. The lawyers at MTC Law understand that adoption can be a complicated process and you may be facing a whirlwind of emotions.
Our adoption lawyers will walk you through the steps so you can focus on your future family.
Guardianship
The responsibility of raising a child falls on the parents, while guardianship is exercised by someone other than the parents. Those who have been granted parental responsibility or have been appointed as guardians hold the power to decide on matters relating to the child’s upbringing, welfare, and financial management. At MTC Law, we help you tread carefully yet confidently as you navigate the new realities of caring for children.
